General terms and conditions
Clear agreements, without fine print tricks. These are the terms under which you use PSILY.

1. Who are we?
PSILY is a service provided by Point2Create BV, Energieweg 1, 3133 EB Vlaardingen, Nederland, KvK 63324547, accessible via [email protected]. These terms apply to any use of the PSILY website and system.
2. What is PSILY?
PSILY stores messages, media and wishes and delivers them at the times you choose — a date, an occasion, or after your death. Additional features include the digital vault, video diary, gift delivery, funeral and will wishes, and the AI Clone.
3. Your account
You are at least 16 years old and provide accurate, up-to-date information. You keep your login details secret and report abuse immediately. For delivery after death, appoint trusted buddies; keep their details up to date, because delivery also depends on their confirmation.
4. Free and Premium, Pricing and Payment
A basic account is free. Premium is available as a monthly subscription (can be canceled monthly), an annual subscription, or a one-off payment for lifetime use; there is also a family account with a fixed price per additional person. All prices are listed on the pricing page and include 21% VAT. Payments are made from your wallet balance and/or via our payment provider. Price changes never apply to periods that have already been paid.
5. Right of withdrawal
As a consumer, you have a 14-day cooling-off period when purchasing online. If you request immediate delivery of a digital service when you purchase it and it has been fully delivered (such as instantly activated Premium features or an instant redeemed credit), the right of withdrawal for that part expires — you confirm this when purchasing. To cancel, please contact us via [email protected].
6. Delivery of your messages
PSILY makes every effort to deliver you messages at the chosen time, with multiple safety nets (life signs, trusted buddies, reminders). Delivery partly depends on factors beyond our control, such as the accuracy of contact details and the cooperation of your counselors. Therefore, keep your information up to date.
7. Your Content
Everything you store with PSILY remains yours. You only give us the technical license necessary to store, process, and deliver your content as you have set. You do not post content that is unlawful, infringes on other people's rights, or is harmful; if misused, we may remove content or terminate the account.
8. The AI Clone
The AI Clone is built with your explicit permission, based on your own recordings. Conversations with an AI Clone are always clearly recognisable as AI. You decide who gets access and can have the AI Clone and the underlying data removed at any time. Answers to an AI model may contain inaccuracies; no rights can be derived from them.
9. The digital safe
The vault is end-to-end encrypted: PSILY has no access to the content and cannot recover it if the passphrase is lost. Keeping the passphrase secure and transmitting it to your recipient is your responsibility.
10. Availability and liability
We maintain PSILY carefully (encrypted backup every hour, continuous monitoring) but cannot guarantee uninterrupted availability. Except in cases of intent or deliberate recklessness, our liability is limited to the amount you have paid to PSILY in the 12 months preceding the event. Nothing in these terms limits rights that are mandatory for you as a consumer.
11. If PSILY were to cease
We commit to the following procedure in the event of termination, sale, or insolvency of the service. You will receive at least six months' notice by email at all addresses known to us. During that period you can export all your data, the recipients you have designated can download the messages sent to them — including those not yet delivered, with a clear indication of the time you intended — and trusted buddies can hold sealed packages for recipients without their own account. Those packages are by default AES-encrypted ZIP files that can be opened with free software such as 7-Zip using the backup key; so PSILY software or assistance is never required. In the event of an acquisition, these obligations transfer to the acquiring party. After the six-month period ends, all data is permanently destroyed, including backups; what is held by an external processor is deleted there as well. The end-to-end encrypted content of the digital vault can never be viewed or transferred by us in any way — it remains accessible only with the keys that you yourself have distributed.
12. Termination by you or by us
You can delete your account at any time. We may terminate an account in the event of a serious breach of these terms, after warning where reasonable. Provisions that by their nature (such as liability) continue to apply afterwards.
13. Changes and applicable law
We may change these terms; we will announce any significant changes in advance and are dated on this page. These terms and conditions are governed by Dutch law; disputes will be submitted to the competent court in the Netherlands, without prejudice to your rights as a consumer.
